{"id":213907,"date":"2016-07-05T16:14:37","date_gmt":"2016-07-05T20:14:37","guid":{"rendered":"http:\/\/172.24.32.11\/daily\/2016\/07\/05\/don_t_be_depressed_over_hillary_clinton_skating_on_the_email_scandal_it_s_now_up_to_trump_and_the_gop_to_make_the_case\/"},"modified":"2017-07-10T11:05:12","modified_gmt":"2017-07-10T15:05:12","slug":"don_t_be_depressed_over_hillary_clinton_skating_on_the_email_scandal_it_s_now_up_to_trump_and_the_gop_to_make_the_case","status":"publish","type":"post","link":"https:\/\/www.rushlimbaugh.com\/daily\/2016\/07\/05\/don_t_be_depressed_over_hillary_clinton_skating_on_the_email_scandal_it_s_now_up_to_trump_and_the_gop_to_make_the_case\/","title":{"rendered":"Don\u2019t Be Depressed Over Hillary Clinton Skating on the Email Scandal: It\u2019s Now Up to Trump and the GOP to Make the Case"},"content":{"rendered":"<p><a href=\"http:\/\/live-rush-limbaugh.pantheonsite.io\/videos\/37\/72129\" target=\"_blank\" rel=\"noopener noreferrer\"><img decoding=\"async\" class=\"alignright\" src=\"\/wp-content\/uploads\/listentoit.jpg\" alt=\"Listen to it Button\" \/><\/a><\/p>\n<section>RUSH: I hope none of you are depressed.\u00a0 I\u2019m sure a lot of you are.\u00a0 <a href=\"http:\/\/live-rush-limbaugh.pantheonsite.io\/daily\/2016\/07\/01\/we_re_being_played_by_the_clintons\" target=\"_blank\" rel=\"noopener noreferrer\">I told you that we were being played throughout this whole thing<\/a>.\u00a0 I never wavered, even when Comey started today.\u00a0 We\u2019ve got some sound bites coming up of the FBI director, James Comey.\u00a0 When he started out, I\u2019m sure there\u2019s some of you, &#8220;Oh, my God, oh, my God, he\u2019s gonna lower the boom!&#8221;<\/p>\n<p>And I knew throughout the whole thing, there\u2019s no way that Barack Hussein O is gonna put Hillary on Air Force One today, fly to a campaign event, if the FBI director is going to recommend she be indicted.\u00a0 It just wasn\u2019t gonna happen.\u00a0 And then, furthermore, this puts in perspective now that apparently off-the-cuff, surprise meeting between Bill Clinton and Loretta Lynch.\u00a0 Well, man, oh, man, isn\u2019t it amazing how that worked out.<\/p>\n<p><a href=\"http:\/\/live-rush-limbaugh.pantheonsite.io\/daily\/2016\/07\/01\/we_re_being_played_by_the_clintons\" target=\"_blank\" rel=\"noopener noreferrer\"><img decoding=\"async\" id=\"eZObject_124426\" class=\"img_middle\" src=\"\/wp-content\/uploads\/2016\/07\/Untitled-3.jpg\" align=\"middle\" \/><\/a>So they have the meeting, it\u2019s discovered by a lone media outlet, the ABC affiliate in Phoenix. It blows up just like that lone picture of the Clintons dancing on the beach three weeks before the Lewinsky story appeared on Drudge. Everybody got all hopped up. And just like that one picture appeared and Mike McCurry in the White House started bellyaching about it, nobody had seen it, it\u2019s pre-internet, front page of the LA Times.\u00a0 What picture?<\/p>\n<p>So they got the picture out everywhere.\u00a0 And then three weeks later here comes the Lewinsky story on Drudge. It had been spiked by Newsweek.\u00a0 Here we go.\u00a0 So you have the one media outlet in Phoenix that finds out Clinton\u2019s on the plane with Lynch.\u00a0 Then it blows up and everybody finds out about it and all hell breaks loose.<\/p>\n<p>Lynch is acting all embarrassed. (imitating Lynch) &#8220;You know what? I tell you what I\u2019m gonna do. I\u2019m gonna back out of this. I am going to accept the recommendation of the FBI and the career prosecutors at the Department of Justice.&#8221;\u00a0 Isn\u2019t she looking like a champion today to the people that matter.\u00a0 She backs out.<\/p>\n<p>Do you think anybody knew what was coming down the pike?\u00a0 I mean, Comey said nobody knew, he hadn\u2019t talked to anybody.\u00a0 If you want to be depressed, look, I understand it.\u00a0 The thing to be really disappointed about is the sad reality that just one institution after another that we used to be able to count on, that we thought was reliable, they all seem to be crumbling right before our very eyes.<\/p>\n<p>So now, where we are with this, I mean, we can parse Comey, we can go through it, andwe will today just for the fun of it.\u00a0 &#8216;Cause you know what I thought I was listening to today?\u00a0 I told Mr. Snerdley, I said, &#8220;James Comey\u2019s press conference today reminded me of Joe Biden\u2019s announcement saying he wasn\u2019t running.&#8221;\u00a0 Remember that?<\/p>\n<p><img decoding=\"async\" id=\"eZObject_124427\" class=\"img_right\" src=\"\/wp-content\/uploads\/2016\/07\/HillaryServerSHORT.jpg\" align=\"right\" \/>Biden goes out and announces he\u2019s not running, but if you listen to the speech all throughout the speech you got the impression he was gonna run, because it laid out an agenda, it detailed what problems exist and how he was gonna solve them.\u00a0 I mean, it was the speech of somebody that was gonna run, and at the end of it he said he\u2019s not going to.\u00a0 I had the same feeling today watching Comey.<\/p>\n<p>He lays out all the violations. He lays out all the irregularities. He lays out all the problems, and there are a lot of people in jail for doing exactly what he\u2019s exonerated Hillary Clinton for today.\u00a0 Where does Petraeus go to get his reputation back?\u00a0 I mean, they charged him with a felony until he settled for something far less than this.<\/p>\n<p>Comey admits that it\u2019s likely that hostile adversaries have seen detailed data from her servers, that she had more than one.\u00a0 He\u2019s going through all this and then says (paraphrasing), &#8220;but there\u2019s nothing to see here.\u00a0 There\u2019s not a reasonable prosecutor out there that would make this case, that would bring these charges.&#8221;\u00a0 I said, &#8220;Man, this is just like the Biden speech for what it\u2019s worth.&#8221;\u00a0 The Clintons pulled a trick.<\/p>\n<p>Here\u2019s another thing.\u00a0 How many of you got all excited when you found out that Cheryl Mills had been brought in there once again for another interview and then took the fifth all these times?\u00a0 Do you know what the Clintons did with that?\u00a0 It\u2019s finally been uncovered.\u00a0 This whole thing started in 2013.\u00a0 Hillary hired a lot of her assistants as her lawyer and then claimed privilege so that they would not have to answer any questions about what went on in her office, and Cheryl Mills is one of those examples.<\/p>\n<p>She hires Cheryl Mills, quote, unquote, as a lawyer, and Mills thus can\u2019t testify because lawyer-client privilege, even though Mills was hired after all of this had happened.\u00a0 Comey didn\u2019t talk about any of that.<\/p>\n<p>So where we are now is that it\u2019s gonna be up to Trump and the Republicans to make the case, since the DOJ is not.\u00a0 I mean, there\u2019s no way that the DOJ is gonna bring charges when the FBI director doesn\u2019t suggest doing so, when there\u2019s no recommendation.<\/p>\n<p><img decoding=\"async\" id=\"eZObject_124428\" class=\"img_middle\" src=\"\/wp-content\/uploads\/2016\/07\/Clintonbill-counting-chickens.jpg\" align=\"middle\" \/>Now, there is a parallel investigation Comey didn\u2019t talk about and that\u2019s into the Clinton Crime Family Foundation.\u00a0 That was another aspect of the Clinton-Lynch meeting that people were saying, &#8220;Wait a minute now, he\u2019s under investigation, too, what the heck\u2019s going on?&#8221;\u00a0 Same thing, folks.\u00a0 I wouldn\u2019t expect anything to come of that, like nothing was gonna ever come of this.\u00a0 I can\u2019t tell you the number of times, and I\u2019m sure it happened to you, too, no matter where you go people ask you, &#8220;Do you think Hillary\u2019s gonna be indicted?&#8221; A lot of people thought, &#8220;I think they\u2019re gonna get her. This is serious stuff. This is playing with fire. This is national security. It\u2019s top secret information.&#8221;<\/p>\n<p>And it\u2019s like every other time. They get all hopped up, all anticipatory, all thinking this is gonna be the time, this is gonna be it.&#8221;\u00a0 And I think the Clintons actually have a playbook strategy.\u00a0 I think one of the things they relish doing is using instances like this to get people on our side all hopped up and eager and excited, thinking that there\u2019s gonna be an actual, in this case indictment or some form of punishment, and they always skate, and people get deflated and depressed and they throw their hands up and despair and say, &#8220;I\u2019m through with it. I\u2019m finished. I don\u2019t care. It doesn\u2019t matter what I do. It doesn\u2019t matter how I vote. They\u2019re gonna win no matter what we do,&#8221; blah, blah, blah.<\/p>\n<p>And that\u2019s their objective, is to dispirit you, depress you, and to have you thinking there\u2019s nothing that can be done to beat them.\u00a0 They just have an answer or a way to slither out of virtually everything.\u00a0 But I do think we were played.\u00a0 I spent a lot of time on Friday detailing why.\u00a0 And it has come to pass.<\/p>\n<p>Let\u2019s go through some of the things here that Comey said.\u00a0 There is evidence that they were extremely careless.\u00a0 &#8220;No evidence of intent to violate law, but evidence of carelessness with classified material.&#8221;\u00a0 I always thought that intent was irrelevant.\u00a0 &#8220;Officer, I didn\u2019t intend to speed.\u00a0 I just wasn\u2019t paying attention.&#8221;\u00a0 Oh, really?\u00a0 Okay, you weren\u2019t trying.\u00a0 Well, then forget that I stopped you.<\/p>\n<p><iframe loading=\"lazy\" src=\"https:\/\/www.youtube.com\/embed\/ghph_361wa0\" width=\"585\" height=\"315\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/p>\n<p>COMEY:\u00a0 Secretary Clinton used multiple servers.\u00a0 The meaning of that is there was no doubt a concerted effort on the part of Mrs. Clinton to keep whatever she was doing out of public view.\u00a0 There\u2019s no question this was going on in total violation of government law.\u00a0 Comey admitted that Crooked Hillary sent and received all levels of classified information.\u00a0 He said the FBI also discovered several thousand work related emails.<\/p>\n<p>Remember that Hillary claimed under oath that she had surrendered all emails but they kept finding things in a drip, drip, drip, drip, drip kind of fashion.\u00a0 FBI director Comey said from 30,000 emails that were deleted by Hillary, 110 emails in 55 email chains contained classified emails, eight of them top secret, 36 secret, but we think that Hillary just deleted emails like you do and like I do.\u00a0 You occasionally decide you need to purge your inbox.\u00a0 So you just start deleting things here and there to make room.\u00a0 You\u2019re not specifically hunting and pecking for which emails to delete; you just select a bunch and you delete \u2019em.\u00a0 And we think that\u2019s all that went on here.<\/p>\n<p><img decoding=\"async\" id=\"eZObject_124430\" class=\"img_middle\" src=\"\/wp-content\/uploads\/2016\/07\/HillaryFBI.jpg\" align=\"middle\" \/>The FBI director said email chains regarding a then-top secret program involved Hillary both sending and receiving emails.\u00a0 The FBI director said there is evidence Clinton and associates were very careless in the handling of classified material and a private server was no place for such careless handling, and yet she did it.\u00a0 And, remember, Petraeus was actually charged with the crimes that Hillary could have been charged with. \u00a0He revealed classified data to his biographer, slash, mistress.\u00a0 She was writing a book on him, he gave her classified information, passed it along, and it was the Regime, it was the Obama administration which pursued and went after Petraeus and basically took him out.<\/p>\n<p>He was somebody at one time being talked about as a potential Republican presidential or vice presidential candidate.\u00a0 But they took care of him.\u00a0 Petraeus\u2019 reputation\u2019s gone, and it\u2019s no better than the guy who did the video that did not incite the protests and the violence at Benghazi.<\/p>\n<p>The FBI director said, &#8220;the security culture of the State Department was generally lacking compared to elsewhere in the US government,&#8221; but still there\u2019s nothing to see here.\u00a0 The FBI director said, &#8220;It is possible hostile actors gained access to Clinton\u2019s personal email account.&#8221;\u00a0 It is possible hostile actors gained access to Clinton\u2019s personal email account.\u00a0 You know, the thing about that, indictment or not, Crooked Hillary allowed top secret information to be open to attack by foreign governments, and WikiLeaks, Julian Assange, who\u2019s still holed up in the Ecuador embassy in Britain, in London, said he\u2019s got enough information to get her indicted.\u00a0 Of course, that\u2019s a moot point now, but he\u2019s gonna keep releasing things.<\/p>\n<p>As I say, it\u2019s gonna be up to Trump and the Republicans now to prosecute Hillary on this.\u00a0 It\u2019s gonna be up to them to make campaign issues out of all these things, the lack of concern, the laziness, whatever charges you want to make about her unfitness and her lack of attention to necessary detail, her unqualified status, if you will, since there will not be any official action.\u00a0 By the way, some people are gonna try to find some positive in that, too.\u00a0 Let me give you a version of how that\u2019s gonna go.<\/p>\n<p><img decoding=\"async\" id=\"eZObject_124431\" class=\"img_middle\" src=\"\/wp-content\/uploads\/2016\/07\/HillaryServerWhy.jpg\" align=\"middle\" \/>&#8220;Hey, Rush, it\u2019s not all bad.\u00a0 Think of it this way.&#8221;\u00a0 And actually I know this \u2019cause I\u2019ve had people write me this this morning.\u00a0 &#8220;Look, if Hillary had been indicted &#8212; and you said it yourself last week &#8212; if Hillary had been indicted, the Democratic Party would have rallied to her and a bunch of Democrat independents would have rallied to her simply because they\u2019re not gonna be sitting around idle and let the Republicans take Hillary out this way, \u2019cause they\u2019ll think it\u2019s a vast right-wing conspiracy, they\u2019ve got her, \u2019cause Comey has long been known as something other than a Democrat. He\u2019s a straight shooter, which means he\u2019s uncorruptible, and so if she had been indicted, Rush, that might have meant either the Democrat Party really circles the wagons and supports her no matter what, or it could have been Biden.\u00a0 Rush, imagine if she has to get out and Biden becomes the guy? I mean, it\u2019d be really, really much more difficult for Trump to beat Biden than it would Hillary, so, Rush, it may be a net positive here.&#8221;<\/p>\n<p>People are gonna be looking for all kinds of things to hold onto here to not give up on everything.\u00a0 I don\u2019t blame people looking for those things.\u00a0 There may be some validity to some of them as well.\u00a0 The FBI director said &#8220;no reasonable prosecutor would bring this case.&#8221;\u00a0 No reasonable prosecutor would bring this case.\u00a0 Now, what Comey brings to this, he\u2019s got a straight shooter reputation.\u00a0 James Comey has, among everybody that knows him, strict law and order, uncorruptible, has not been corrupted to this point in time.<\/p>\n<p><img decoding=\"async\" id=\"eZObject_124425\" class=\"img_right\" src=\"\/wp-content\/uploads\/2016\/07\/HillaryShort1.jpg\" align=\"right\" \/>If Comey says it, you can trust it.\u00a0 That\u2019s his reputation.\u00a0 When he says no reasonable prosecutor would bring this case, it\u2019s kind of like saying no reasonable Supreme Court justice would ever look at Obamacare and call it constitutional.\u00a0 Or further, no reasonable Supreme Court chief justice would ever take Obamacare and rewrite it from the bench to make it constitutional.\u00a0 So what we had here, the FBI director detailed gross misconduct and then said there will be no prosecution.<\/p>\n<p>The bottom line from Comey:\u00a0 &#8220;Although there is evidence of potential violations of the statutes regarding the handling of classified information, our judgment is that no reasonable prosecutor would bring such a case.&#8221;\u00a0 Although there is evidence of potential violations of the statutes regarding the handling of classified information, our judgment is that no reasonable prosecutor would bring such a case.\u00a0 There is evidence, potential violations.\u00a0 Isn\u2019t that one of the things you do a trial for?<\/p>\n<p>Mr. Snerdley, a pop quiz.\u00a0 Who was the last &#8212; well, I don\u2019t want to give the answer away in the question.\u00a0 Who was the last public figure we were all told in the legal system, straight shooter, you can trust this guy, he is untainted by either party, this guy\u2019s a bulldog, he puts his nose to the grindstone and he digs it out until he\u2019s got the truth, and when he gets it, you can count on it.\u00a0 Right! Patrick Fitzgerald, who was the special prosecutor that nailed Scooter Libby for lying to him in the Valerie Jarrett leak case, even though we all knew who leaked her name. They got Scooter Libby for supposedly lying during the investigation.<\/p>\n<p>So Patrick Fitzgerald, we were all told this guy\u2019s above the law. You can\u2019t taint this guy. He\u2019s a straight shooter, that\u2019s all he cares about, is the law. He doesn\u2019t have a girlfriend. He eats pizza out of boxes and drinks Diet Coke and doesn\u2019t even have any furniture except a wooden chair in his apartment; that\u2019s how serious he is.\u00a0 And they say the same thing about Comey.<\/p>\n<p>BREAK TRANSCRIPT<\/p>\n<p><img decoding=\"async\" id=\"eZObject_124432\" class=\"img_right\" src=\"\/wp-content\/uploads\/2016\/07\/HillaryBenghazishort_large.jpg\" align=\"right\" \/>RUSH:\u00a0 I\u2019m holding here in my formerly nicotine-stained fingers a story from TheHill.com just today.\u00a0 Ready for the headline?\u00a0<a href=\"http:\/\/thehill.com\/blogs\/blog-briefing-room\/news\/286490-court-officials-cant-use-private-email-accounts-to-evade\" target=\"_blank\" rel=\"noopener noreferrer\">\u00a0&#8220;Court: Officials Can\u2019t Use Private Email Accounts to Evade Records Laws.&#8221;<\/a> That\u2019s TheHill.com, July 5th, 2016.\u00a0 &#8220;Federal officials may not use private email accounts to get around public records laws, a federal judge ruled on Tuesday.\u00a0\u00a0 The US Court of Appeals for the DC Circuit overturned a lower court decision in which judges dismissed claims from the Competitive Enterprise Institute, a conservative think tank that attempted to obtain correspondence from a top White House official through the Freedom of Information Act (FOIA).<\/p>\n<p>&#8220;The White House\u2019s Office of Science and Technology Policy (OSTP) said it did not need to search for or turn over records held by the head of the OSTP on a private email account as part of the open records request.&#8221; So to review: A conservative think tank wants records from the guy who runs the White House Office of Science and Technology Policy, and the White House says (summarized), &#8220;No. Those emails are on his private server, and you can\u2019t get them.&#8221; So the White House specifically cited private server location &#8212; private email server location &#8212; as a means of denying a Freedom of Information Act request.<\/p>\n<p>Which is, by the way, why Hillary did this in part.\u00a0 There were many reasons.\u00a0 &#8220;In addition to official White House email, John Holdren, the director of the OSTP, also sent and received emails from a domain at the Woods Hole Research Center.&#8221;\u00a0 So a judge (his name is David Sentelle) disagreed.\u00a0 He said if&#8230; I don\u2019t have time to read you his ruling, but the bottom line is you can\u2019t use a private email server to shield your work from FOIA requests.\u00a0 What a day to hear that!<\/p>\n<p>BREAK TRANSCRIPT<\/p>\n<p>RUSH:\u00a0 Well, see, Donald Trump\u2019s had a couple of tweets.\u00a0 The first one:\u00a0 &#8220;FBI director said Crooked Hillary compromised our national security.\u00a0 No charges.\u00a0 Wow.&#8221;\u00a0 And he also tweeted out: &#8220;The system\u2019s rigged.\u00a0 General Petraeus got in trouble for far less.\u00a0 Very, very unfair.\u00a0 As usual, bad judgment.&#8221;<\/p>\n<p>As I say, it\u2019s gonna be up to Trump to make the case now.\u00a0 The Trump campaign, his surrogates and the Republican Party.\u00a0 The Republican Party is not going to be comfortable doing this. My guess is, DOJ exonerates, which is what this is, no reason prosecutor.\u00a0 The FBI exonerates, no reasonable prosecutor.\u00a0 But I want to go through this again because this just flew out here from TheHill.com.<\/p>\n<p>&#8220;Federal officials may not use private email accounts to get around public records laws, a federal judge ruled on Tuesday. &#8230; David Sentelle, the chief judge of the US Court of Appeals for the DC Circuit,&#8221; disagreeing with the government.\u00a0 &#8220;Throughout the case, the government argued that &#8216;[d]ocuments on a nongovernmental email server are outside the possession or control of federal agencies, and thus beyond the scope of FOIA.'&#8221;<\/p>\n<p><img decoding=\"async\" id=\"eZObject_124435\" class=\"img_middle\" src=\"\/wp-content\/uploads\/2016\/07\/TrumpHill-Trump-B.jpg\" align=\"middle\" \/>We\u2019ve mentioned this before but everybody thinks that Hillary decided to do this on her own, but the more you look at this administration, all kinds of people did this.\u00a0 Here we have the science guy, there have been others we have learned that kept official documents. Yeah, Lisa Jackson over the EPA, now working for Apple.\u00a0 She had a private email server, and all of it was to escape Freedom of Information Act requests, which makes total sense.<\/p>\n<p>I mean, here we have a Democrat Party administration which does not believe in transparency, which wants to hide everything it does, cannot even be honest and open about its agenda if it wants to win elections.\u00a0 The Democrat Party to this day, even though people think the country\u2019s lost in many ways, I still maintain to you that if Obama had run a campaign based on exactly what\u2019s happened, promised he was going to do exactly what he\u2019s done, he would not have been elected.<\/p>\n<p>The Democrat Party, the American left cannot be honest.\u00a0 They have to use subterfuge.\u00a0 They have to deceive.\u00a0 They have to lie.\u00a0 And here they are with numerous officials, private email servers making the case in court, &#8220;Hey, private email servers, even if it\u2019s government related, you can\u2019t see it, private email.\u00a0 Freedom of Information Act has no purview there.<\/p>\n<p>And the judge said, &#8220;If a department head can deprive the citizens of their right to know what his department is up to by the simple expedient of maintaining his departmental emails on an account in another domain, that purpose is hardly served,&#8221; Sentelle wrote.\u00a0 &#8220;It would make as much sense to say that the department head could deprive requestors of hard-copy documents by leaving them in a file at his daughter\u2019s house and then claiming that they are under her control,&#8221; he said.<\/p>\n<p>Which is a brilliant point.\u00a0 Let\u2019s say we\u2019re not even talking about email. Let\u2019s say some people have the some paper documents, they work for the government, but they\u2019re over at the employee\u2019s daughter\u2019s house, and here comes some think tank or news agency that wants to see them under FOIA.\u00a0 &#8220;Sorry, he doesn\u2019t have them. They\u2019re at his daughter\u2019s house, you can\u2019t get them.&#8221; \u00a0No different.\u00a0 It\u2019s absurd. And it\u2019s no different than, &#8220;Well, you can\u2019t see them. They\u2019re on his private server and his private server is not subject.&#8221;<\/p>\n<p>&#8220;But it\u2019s government business on his private server.&#8221;<\/p>\n<p>&#8220;It doesn\u2019t matter.&#8221;\u00a0 So it begins to appear to me that the Obama administration may have had a hand in setting this up to begin with.\u00a0 And, by the way, folks, Obama was communicating with Hillary knowing full well she had this, you know, off-site server, this private server.\u00a0 It was not news to anybody.\u00a0 I think it\u2019s part of the practice that these people engage in regularly to deceive the American people and to continue to be able to operate in the darkness without any sunlight.<\/p>\n<p>I just find it ironic that here we have an appellate court decision saying that government officials cannot use private email accounts to evade records laws, and the same day the FBI says: Nothing to see here. No reasonable prosecutor would ever bring this case. No criminal activity here. No willful intent. Mrs. Clinton is basically a non-tech person, didn\u2019t know what she was doing. She didn\u2019t intend to break the law. She didn\u2019t intend to do this. Yeah, some hostile actors might have seen the stuff but we don\u2019t know for sure because we couldn\u2019t find any direct evidence that she\u2019d been hacked.<\/p>\n<p>The willful suspension of common sense is what is necessary to get through each and every day when the country\u2019s run by a bunch of leftists and globalists and statists.\u00a0 In order to maintain your sanity, you have to willfully suspend your common sense, because everything they do is in utter defiance of that.<\/p>\n<p><img decoding=\"async\" id=\"eZObject_124436\" class=\"img_right\" src=\"\/wp-content\/uploads\/2016\/07\/RushPhonesgoSHORT.jpg\" align=\"right\" \/>Let\u2019s get to the phones.\u00a0 I know a lot of people want to weigh in.\u00a0 We\u2019re gonna start in Pleasanton, California, with Chris.\u00a0 Have at it, sir.\u00a0 You\u2019re up first.<\/p>\n<p>CALLER:\u00a0 Yeah, hi, Rush.\u00a0 Mega dittos.<\/p>\n<p>RUSH:\u00a0 Thank you, sir.<\/p>\n<p>CALLER:\u00a0 Hey, remember the IRS scandal?\u00a0 We had kind of a similar circumstance.\u00a0 We had people taking the fifth, disappearing emails. I remember the grown that went through the crowd when the director, Koskinen I believe his name is, said we destroyed some of the hard drives.\u00a0 And early on, Obama said, &#8220;Don\u2019t worry, we have the FBI looking into this.&#8221;\u00a0 As I\u2019ve been saying to my friends for months, &#8220;Why would we have confidence now when they said, &#8216;Oh, we have a straight shooter handling this,\u2019 when we see how the IRS scandal was handled?&#8221;<\/p>\n<p>RUSH:\u00a0 You\u2019re absolutely right.\u00a0 This is our old buddy John Koskinen who ran the IRS and he\u2019s up there testifying, and he says under oath, I forget which, either the stuff was not backed up or the copies of the backup were lost or whatever the case was, it was gone.\u00a0 Sorry, Congress, we can\u2019t get it.\u00a0 It\u2019s gone.<\/p>\n<p>And everyone is saying, &#8220;Come on, everything\u2019s routinely backed up.\u00a0 A copy of whatever somebody wants is somewhere.&#8221;\u00a0 And then months went by, after the emotion of the case had dissipated, and all of a sudden they found it.\u00a0 And Koskinen had been lying all along.\u00a0 And finally now Congress is prepared to &#8212; well, they were preparing &#8212; I don\u2019t know what the status is of impeachment proceedings against Koskinen at the IRS.\u00a0 But, yeah, it\u2019s the same thing.<\/p>\n<p>And you\u2019re right, Obama did say, don\u2019t sweat it, the FBI will get to the bottom of it.\u00a0 And of course the FBI didn\u2019t get to the bottom of anything.\u00a0 FOIA and the IRS skated, literally skated.\u00a0 This was the case involving Katherine Engelbrecht\u2019s group. The Tea Party wanted tax-exempt status and they were never granted it to fundraise for the Tea Party.\u00a0 This was the Lois Lerner operation.\u00a0 It was Obama\u2019s operation is what all this really adds up to and means.<\/p>\n<p><img decoding=\"async\" id=\"eZObject_124437\" class=\"img_middle\" src=\"\/wp-content\/uploads\/2016\/07\/HillaryemailsSecurity-Risk-2B.jpg\" align=\"middle\" \/>And they got away with stonewalling and lying (imitating Koskinen), &#8220;Sorry, there aren\u2019t any backups, sorry.\u00a0 You know what?\u00a0 Somebody erased them.\u00a0 You know what?\u00a0 We got this giant degausser back there, and, unbeknownst to us, everything is just erased.\u00a0 I\u2019m sorry, it\u2019s gone,&#8221; said Koskinen.\u00a0 Or the backups were never made, or some such thing.\u00a0 And he said it with a smile on his face. He said it with a smile, almost a contemptuous sneer on his face as he was telling Republican members of Congress that what they wanted was gone, was irretrievable.<\/p>\n<p>And then later when there wasn\u2019t any emotion left, months and months had gone by, somebody found the stuff.\u00a0 But the caller\u2019s point, Chris\u2019s point is here that we should have seen this coming \u2019cause the FBI was brought into that.\u00a0 We were told the FBI\u2019s looking into it and we\u2019ll get to the bottom of it, Obama said that, and it should have been a tip-off.\u00a0 Well, the tip-off for me is that it\u2019s the Clintons.\u00a0 The tip-off for me it\u2019s the Clintons and it\u2019s the Democrat Party and a presidential campaign.<\/p>\n<p>And I\u2019m sorry, folks, like I said last Friday, there\u2019s just no way that a Democrat administration is going to take action that would result in their presidential candidate, their nominee being forced out of the race, unless there was something that we don\u2019t know about that made it almost required that this candidate get out because there was something worse to come that had not been learned.\u00a0 But under normal circumstances there\u2019s no way to think that.<\/p>\n<p>This is the Democrat Party, for crying out loud.\u00a0 They use government to get their way.\u00a0 They use government to advance their agenda.\u00a0 They use government to protect their people.\u00a0 They use government to cover up whatever they do to advance their agenda.\u00a0 All of a sudden they\u2019re gonna come along and recommend that they\u2019re presidential presumptive nominee be indicted?\u00a0 It was just never gonna happen.\u00a0 &#8220;Yeah, Rush, about what about Comey is a straight shooter, supposedly he\u2019s not &#8211;&#8221;\u00a0 Well, draw your own conclusions.<\/p>\n<p>Who\u2019s next?\u00a0 This is Elizabeth in St. Louis.\u00a0 Great to have you, Elizabeth.\u00a0 You\u2019re next.\u00a0 Hello.<\/p>\n<p>CALLER:\u00a0 Hello there.<\/p>\n<p>RUSH:\u00a0 Hi.<\/p>\n<p><img decoding=\"async\" id=\"eZObject_124439\" class=\"img_middle\" src=\"\/wp-content\/uploads\/2016\/07\/HillaryFace2.jpg\" align=\"middle\" \/>CALLER:\u00a0 Listen, once again, you know, the Clintons have been given a pass.\u00a0 And they always get a pass, whether it\u2019s from SNL or the mainstream media or the Justice Department.\u00a0 And the only ones that can take away that pass are the American voters.\u00a0 We have to defeat Hillary Clinton at the ballot box.\u00a0 It is the only way to get rid of them.\u00a0 And it has to be a decisive defeat.\u00a0 In my mind, we can\u2019t count, like you say, we can\u2019t count on the institutions that always served this nation so honorably.\u00a0 They just don\u2019t seem to work the way they used to work.\u00a0 And I don\u2019t think the American people are blind.\u00a0 I think that people see that.\u00a0 They get that.\u00a0 And if we can beat her at the ballot box, I mean, we could have &#8212;<\/p>\n<p>RUSH:\u00a0 Well, let\u2019s talk about that for a second.\u00a0 Mrs. Clinton, if you look at the people making a big deal out of this today, and they have been in recent days, comparing Democrat primary turnout, total turnout, say, in 2008 for Obama and this year for Hillary, they\u2019re down 10 million votes.\u00a0 I mean, so many fewer Democrats showed up to vote for Hillary and Bernie combined, than voted for Obama.\u00a0 And the analysis of that is that there\u2019s just isn\u2019t any enthusiasm on Democrat Party side.<\/p>\n<p><iframe loading=\"lazy\" src=\"https:\/\/www.youtube.com\/embed\/r7e6gLht6OQ\" width=\"585\" height=\"315\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/p>\n<p>Forget what we saw with Crazy Bernie.\u00a0 There just isn\u2019t any enthusiasm at all.\u00a0 Yet Republican turnout is way up, record turnout, record number of Republican votes cast.\u00a0 Now, they use this to argue that Mrs. Clinton doesn\u2019t have any pizzazz. She doesn\u2019t have any enthusiasm behind her, and some people are saying, you know, this ruling today may be okay because if she had been indicted, if the FBI director had come out and said, &#8220;We recommend that she be charged,&#8221; that puts pressure on the DOJ.\u00a0 But that would cause Democrats to circle the wagons just to protect her from being damaged by us.\u00a0 Now that\u2019s not gonna happen.<\/p>\n<p>So do you put any stock &#8212; you said you trust the American people.\u00a0 The polling data\u2019s out there, Hillary\u2019s up by nine, Hillary\u2019s up by five, depending on the story, Trump is closing the gap.\u00a0 She\u2019s spending all kinds of money. He\u2019s spending zero.\u00a0 How\u2019s all this making you feel?<\/p>\n<p>CALLER:\u00a0 Well, I really believe that the American people, they don\u2019t like Hillary Clinton.\u00a0 I mean, it\u2019s one thing to talk about Bill Clinton.\u00a0 I think they basically like that guy, but I have always felt ever since Hillarycare that the American people, they just flat-out don\u2019t really like her.\u00a0 And I think that does mean something.<\/p>\n<p>RUSH:\u00a0 Well, we\u2019ll find out.\u00a0 It isn\u2019t gonna take long.\u00a0 It\u2019s clear that she does not have a connection.\u00a0 I know, I keep saying that, folks, but I do so for a reason, because it matters.\u00a0 Any Democrat, any presidential candidate that the Democrats put up, anybody with a D next to their name is guaranteed a certain percentage of the vote.\u00a0 People are just gonna show up, it doesn\u2019t matter.<\/p>\n<p>She does not have a personal connection with most of those people.\u00a0 They\u2019re showing party loyalty, not Hillary investment.\u00a0 She just doesn\u2019t have that, because she isn\u2019t that likable, and she doesn\u2019t relate.\u00a0 She doesn\u2019t even try to establish such connections, just like tyrants don\u2019t.\u00a0 It doesn\u2019t matter whether people love \u2019em or hate \u2019em.\u00a0 It has nothing to do with what they do and how they do it each and every day.<\/p>\n<p>Anyway, I\u2019m a little long so I gotta take a break.\u00a0 I appreciate the call, Elizabeth.<\/p>\n<p>BREAK TRANSCRIPT<\/p>\n<p>RUSH: The legal aspect is one thing, but the political aspect of this is by no means over, and if <a href=\"https:\/\/www.washingtonpost.com\/news\/the-fix\/wp\/2016\/07\/05\/hillary-clintons-email-problems-might-be-even-worse-than-we-thought\/\" target=\"_blank\" rel=\"noopener noreferrer\">Chris Cillizza at the Washington Post <\/a>is any kind of a canary in the mine, then Mrs. Clinton is by no means out of the woods here.\u00a0 And I don\u2019t mean to be engaging in false optimism here.\u00a0 I know that a lot of people are dispirited and depressed, even though I warned everybody that we were being played by all this stuff that happened last week.<\/p>\n<p>I mean, they want you dispirited.\u00a0 They want you down.\u00a0 They want you giving up.\u00a0 They want you thinking you can\u2019t get them, not just the Clintons, but Obama, anybody.\u00a0 They want you thinking that you are powerless to stop them. They tease you and they make you think that you\u2019re on the verge of getting \u2019em, and then the shoe drops and there\u2019s nothing to see, nothing there, and everybody gets depressed and goes away.\u00a0 And they\u2019ve done this enough that they\u2019ve had, I think, a successful run at turning people off of politics and dispiriting them.\u00a0 And don\u2019t let that happen to you, folks.<\/p>\n<p>This woman cannot win this election coming up.\u00a0 This just cannot happen.\u00a0 So if you\u2019re momentarily spent, if you\u2019re momentarily depressed, if you\u2019re throwing up your hands in frustration, go ahead and experience it for a while, but come back, \u2019cause this is just getting warmed up.\u00a0 This is just step one.\u00a0 Somebody might be able to make the case that politically this is more advantageous than having her be indicted.<\/p>\n<p>Now, terms rule of law, it would have been best if the law had trumped here, but it didn\u2019t, so there may be some advantageous results here politically. We\u2019ll get into that today and as the days and week unfold before us.<\/p>\n<p>BREAK TRANSCRIPT<\/p>\n<p>RUSH:\u00a0 Here.\u00a0 Let me just give you the big one.\u00a0 I could go through the list of things that Comey said, but here\u2019s the big one.\u00a0 &#8220;Although there is evidence of potential violations of the statutes regarding the handling of classified information, our judgment is no reasonable prosecutor would bring such a case.&#8221;\u00a0 That\u2019s all you need if you\u2019re Donald Trump.\u00a0 That\u2019s all you need, plus there\u2019s more.<\/p>\n<p><img decoding=\"async\" id=\"eZObject_124459\" class=\"img_middle\" src=\"\/wp-content\/uploads\/2016\/07\/HillaryBlumenthal.jpg\" align=\"middle\" \/>&#8220;Although there is evidence&#8221; &#8212; this is the FBI director, the investigating authority here.\u00a0 &#8220;Although there is evidence of potential violations of the statutes regarding the handling of classified information,&#8221; da-da-da-da-da, &#8220;our judgment is that no reasonable prosecutor would bring such a case.&#8221;\u00a0 You know, she\u2019s running around running ads saying that Trump is unfit, that he is unqualified, that he doesn\u2019t have the right temperament.\u00a0 Well, let\u2019s turn it around.\u00a0 This woman obviously is unqualified.<\/p>\n<p>She\u2019s engaging here, the FBI director pretty much said and her defenders on CNN are pretty much saying that the way she skated was she didn\u2019t intend to divulge US national security secrets.\u00a0 She didn\u2019t intend to traffic in top secret documents.\u00a0 She didn\u2019t intend.\u00a0 And yet the statute that they go after her for if they did would be one that charges her with gross negligence.\u00a0 And Andy McCarthy\u2019s point is, how in the world does intent have anything to do with gross negligence?\u00a0 Gross negligence, by definition, eliminates whether there was intent or not.<\/p>\n<p>Again, there are two statutes in play here.\u00a0 Let me see if I can make sense of this again for you.\u00a0 According to Director Comey, &#8220;Hillary Clinton checked every box required for a felony violation of Section 793(f) of the federal penal code (Title 18).&#8221; \u00a0That\u2019s where we get the statement, &#8220;Although there is evidence of potential violations of the statutes regarding the handling of classified information, our judgment is that no reasonable prosecutor would bring such a case.&#8221;<\/p>\n<p>Before I go through this further, let me review some of Comey\u2019s statements here.\u00a0 &#8220;There is evidence that they were extremely careless.\u00a0 No evidence of intent to violate law but evidence of carelessness with classified material.\u00a0 Secretary Clinton used multiple servers.&#8221;\u00a0 What do you mean, she didn\u2019t intend?\u00a0 She intended to keep all of this private.\u00a0 That\u2019s the whole point.\u00a0 There\u2019s your intent right there.\u00a0 But, no, she didn\u2019t intend to traffic in top secret information, classified information.<\/p>\n<p>&#8220;Hillary Clinton sent and received all levels of classified information.\u00a0 The FBI discovered several thousand work-related emails.\u00a0 This is after Hillary Clinton claimed under oath that she had surrendered them all.&#8221;\u00a0 They found additional emails, work related, that she had not surrendered, even though she had told them and promised them she had.<\/p>\n<p>From Comey:\u00a0 30,000 emails that were deleted by Hillary Clinton, from those 30,000, 110 emails and 55 email chains contained classified emails, eight top secret, 36 secret.\u00a0 Now, I ran through that in a hurry the first time.\u00a0 But let\u2019s analyze this.\u00a0 From 30,000 emails that were deleted, there were 60,000-plus emails on her server.\u00a0 She said 30,000 of them are private and personal, have nothing to bear here.\u00a0 They have to do with yoga and my daughter\u2019s wedding and all that other kind of stuff, and I\u2019m not turning those over.<\/p>\n<p><img decoding=\"async\" id=\"eZObject_124460\" class=\"img_middle\" src=\"\/wp-content\/uploads\/2016\/07\/HillaryWeb.jpg\" align=\"middle\" \/>She turned over 30,000 of the 60,000.\u00a0 Comey said today that from the 30,000 deleted, from the 30,000 she did not turn over they found 110 emails and 55 email chains that contained classified emails, eight of which were top secret, 36 were secret.\u00a0 Yet she didn\u2019t intend to traffic in this stuff.\u00a0 And I guess it also means she didn\u2019t intend to delete them, because Comey said she deleted emails like you and I do.\u00a0 We look at our in box, it gets big, we start deleting things to bring it down, make it a smaller size. We randomly select emails to delete here or there.\u00a0 That\u2019s what we found she did.<\/p>\n<p>So 60,000 emails, 30,000 of \u2019em she says are irrelevant, and that\u2019s not challenged by the way.\u00a0 She turns over 30,000.\u00a0 And, remember, they were turned over in hard copy paper form, if you recall.\u00a0 Well, apparently the FBI found some of the 30,000 that she deleted or did not turn over.\u00a0 And in that 30,000 they found 110 emails and 55 email chains containing classified information.\u00a0 But there\u2019s nothing to see here, because she didn\u2019t intend to traffic in the stuff.\u00a0 But she didn\u2019t turn it over.<\/p>\n<p>Comey said that email chains regarding a then top secret program involved Hillary Clinton both sending and receiving emails, but I guess she didn\u2019t intend to be disseminating classified information.\u00a0 Comey said there is evidence that Clinton and associates are very careless in the handling of classified material, and a private server is no place for such.\u00a0 But still no recommendation to indict.<\/p>\n<p>Comey said the security culture of the State Department was generally lacking compared to elsewhere in the US government.\u00a0 He said that it is possible that hostile actors gained access to Clinton\u2019s personal email account.\u00a0 So, you know, whether she\u2019s indicted or not, or whether she intended to or not, Hillary Clinton, by virtue of Comey\u2019s press conference today, allowed top secret information to be open to attack by foreign governments.\u00a0 And after saying all that, the FBI director said no reasonable prosecutor would bring this case.\u00a0 Which is why I say, and of course no reasonable Supreme Court chief justice would deny America\u2019s first black president an unconstitutional law, like Obamacare.<\/p>\n<p><img decoding=\"async\" id=\"eZObject_124464\" class=\"img_middle\" src=\"\/wp-content\/uploads\/2016\/07\/ObamaHillary.jpg\" align=\"middle\" \/>So Comey detailed gross negligence.\u00a0 He detailed gross misconduct and says there\u2019s not gonna be a prosecution because there was no intent.\u00a0 So how do you get there?\u00a0 Well, again, according to Andy McCarthy, Comey admitted, like I just detailed for you, that Hillary Clinton checked off every box required for a felony Violation of Title 18, Section 793(f).\u00a0 Title 18 is the federal penal code.\u00a0 With lawful access to highly classified information, she acted with gross negligence in removing and causing it to be removed from its proper place of custody, and then she transmitted it and caused it to be transmitted to others not authorized to have it, in patent violation of her trust.\u00a0 Gross negligence.<\/p>\n<p>Director Comey even conceded that she was extremely careless, as I just read to you, and strongly suggested that her recklessness very likely led to communications, her own and those she corresponded to being intercepted by foreign intelligence services.\u00a0 He admits all this.<\/p>\n<p>So there\u2019s not an exoneration here, is my point.\u00a0 There is a legal, &#8220;Well, there\u2019s not enough here for us to prosecute. We\u2019re not sure we can get a conviction.&#8221;\u00a0 But in the political world this is just beginning.\u00a0 So, in order to give Hillary Clinton a pass, what the FBI did, apparently, was rewrite the statute, inserting an intent element that Congress did not require.\u00a0 Section 793(f) of the federal penal code, Title 18, does not require an intent element.<\/p>\n<p>The added intent element makes no sense, because the point of having a statute that criminalizes gross negligence is to underscore that government officials have a special obligation to be careful with national defense secrets.\u00a0 And when they fail, to be careful, when they fail to carry out that obligation, because they have been grossly negligent, then they are guilty of serious wrongdoing.<\/p>\n<p>The lack of intent is irrelevant.\u00a0 People never intend the bad things that happen due to gross negligence.\u00a0 They may roll the dice and hope nothing happens, but they don\u2019t intend to.\u00a0 It\u2019s why, when you have a gross negligence statute, it\u2019s irrelevant to put intent in it or not.<\/p>\n<p><img decoding=\"async\" id=\"eZObject_124465\" class=\"img_right\" src=\"\/wp-content\/uploads\/2016\/07\/485410320_large.jpg\" align=\"right\" \/>So what happened here?\u00a0 Well, there happens to be another statute that does require intent, that does not expressly deal with what Hillary trafficked in.\u00a0 But apparently that statute that requires intent is what is being used here in order to arrive at the conclusion that no prosecution is recommended.\u00a0 The FBI has told the public that because Mrs. Clinton did not have intent to harm the United States, we should not prosecute her on a felony that does not require proof of intent to harm the US.<\/p>\n<p>Meanwhile, although there may have been profound harm to national security caused by her and her grossly negligent mishandling of classified information, we, the FBI, have decided she shouldn\u2019t be prosecuted for grossly negligent mishandling of classified information.\u00a0 We have decided she shouldn\u2019t be prosecuted because she didn\u2019t intend any of it.<\/p>\n<p>And that\u2019s the commingling of the statutes.\u00a0 It makes no sense.\u00a0 If you\u2019re trying to make sense of it, stop.\u00a0 It doesn\u2019t make any sense.\u00a0 It\u2019s the commingling &#8212; my word &#8212; of two statutes.\u00a0 One requires intent.\u00a0 The other one is simply based on gross negligence.\u00a0 So they\u2019ve flip-flopped \u2019em, in a sense, \u2019cause they can.\u00a0 It\u2019s that simple.<\/p>\n<p>Anyway, look, it\u2019s a long answer to our caller, but the caller wanted to make the case now that since she\u2019s been exonerated &#8212; she hasn\u2019t been.\u00a0 Comey did not exonerate her.\u00a0 Comey just said, we can\u2019t find a successful route to prosecute her because she didn\u2019t intend to do any of this.<\/p>\n<\/section>\n","protected":false},"excerpt":{"rendered":"<p>RUSH: I hope none of you are depressed.\u00a0 I\u2019m sure a lot of you are.\u00a0 I told you that we were being played throughout this whole thing.\u00a0 I never wavered, even when Comey started today.\u00a0 We\u2019ve got some sound bites coming up of the FBI director, James Comey.\u00a0 When he started out, I\u2019m sure there\u2019s [&hellip;]<\/p>\n","protected":false},"author":70,"featured_media":0,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_et_pb_use_builder":"","_et_pb_old_content":"","_et_gb_content_width":"","ngg_post_thumbnail":0,"footnotes":""},"categories":[1],"tags":[],"class_list":["post-213907","post","type-post","status-publish","format-standard","hentry","category-uncategorized"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.0 -
